Gramm-Leach-Bliley Compliance Overview

Adam_T4Gramm-Leach-Bliley, also known as the “Safeguards Rule” requires all financial institutions (banks, credit unions, advisors and other entities that handle financial transactions) to protect consumer information. The law also applies to other entities which receive customer information from financial institutions. Established in 1999, Gramm-Leach-Bliley repealed part of the Glass-Steagall Act of 1933 allowing commercial banks, investment banks, security firms and insurance companies to consolidate. There are three main areas to Gramm-Leach-Bliley compliance:

  • Financial Privacy Rule — outlines privacy notification to consumers at the time a relationship is established and then annually

  • Safeguards Rule — requires a written security plan describing how a company is protecting a client’s nonpublic personal information

  • Pretexting Protection — applies to how employees ensure that client information/accounts are not given to persons impersonating an account holder
